国際ビジネス、渉外法務に役立つ実務表現 juridical person 【意味】 法人 【参考】 ▷ 「自然人」(natural person)に対する語で、法によって特別に権利能力が付与されて、権利主体となりうるもの(存在)である。“artificial[juristic, legal] person,” “juridical entity”なども同様の意味で使われる。 ▷ a non-human legal entity, any organization that is not a single natural person but is authorized by law with duties and rights. 【用例】 ▷ No juridical person can be formed unless it is formed pursuant to the applicable provisions of this Code or other laws. →法人は、この法律その他の法律の規定によらなければ、成立しない(民法33条1項)。 ▷ A juridical person shall have rights and assume duties to the extent of the purpose provided in the applicable articles of incorporation or act of endowment subject to the applicable provisions of the laws and regulations. →法人は、法令の規定に従い、定款又は寄附行為で定められた目的の範囲内において、権利を有し、義務を負う(削除前民法43条)。
