国際ビジネス、渉外法務に役立つ実務表現 conformity 【意味】 (法規・慣習などに)従うこと，適合 (v) conform + in conformity with[to] ~ →(法規・慣習など)に従って<in a way that obeys rules, customs, etc.> 【用例】 ▷ The buyer loses the right to rely on a lack of conformity of the goods if he does not give notice to the seller specifying the nature of the lack of conformity within a reasonable time after he has discovered it or ought to have discovered it. →買主は、物品の不適合を発見し、又は発見すべきであった時から合理的な期間内に売主に対して不適合の性質を特定した通知を行わない場合には、物品の不適合を援用する権利を失う(ウィーン売買条約39条(1))。 ▷ Questions concerning matters governed by this Convention which are not expressly settled in it are to be settled in conformity with the general principles on which it is based or, in the absence of such principles, in conformity with the law applicable by virtue of the rules of private international law. →この条約が規律する事項に関する問題であって、この条約において明示的に解決されていないものについては、この条約の基礎を成す一般原則に従い、又はそのような原則がない場合には国際私法の準則により適用される法に従って解決する(ウィーン売買条約7条(2))。 ▷ The buyer may declare the contract avoided in its entirety only if the failure to make delivery completely or in conformity with the contract amounts to a fundamental breach of the contract. →買主は、完全な引渡し又は契約に適合した引渡しが行われないことが重大な契約違反となる場合に限り、その契約の全部を解除する旨の意思表示をすることができる(ウィーン売買条約51条(2))。
