国際ビジネス、渉外法務に役立つ実務表現 formality 【意味】 形式，(要式行為における)方式 【参考】 ▷ something that has to be done but has no real importance; something that the law or an official process says must be done. 【用例】 ▷ You'll have to sign the visitors' book, but it's just a formality. →あなたは来客帳に署名しなければならないが、それは単なる形式的なものだ。 ▷ We have to observe the formalities. →われわれは要式を守らなければならない。 ▷ Unless otherwise provided for in laws and regulations, it is not required to satisfy any formalities such as preparation of a written document in order to form a contract. →契約の成立には、法令に特別の定めがある場合を除き、書面の作成その他の方式を具備することを要しない(民法522条2項)。 ▷ Enjoyment of the moral rights of an author and of copyrights requires no formalities. →著作者人格権及び著作権の享有には、いかなる方式の履行をも要しない(著作権法17条2項)。 ▷ The formalities for a juridical act are governed by a law applicable to the formation of the act. →法律行為の方式は、当該法律行為の成立について適用すべき法による(法の適用に関する通則法10条1項参照)。
