国際ビジネス、渉外法務に役立つ実務表現 in witness whereof 【意味】 以上の証として 【参考】 ▷ 名詞のwitnessには「証拠」「証拠物件」<evidence; proof.>という意味があり、“in witness of ~”(～の証拠として)の形で、しばしば、当該(法律)文書が正式に成立したことを示すために使われます。とりわけ契約書の末尾に用いて、当該契約書が正式に成立した旨を示す定型表現として、“in witness whereof”があり、これは、「以上の証として」といった程度の意味で使われます。 ▷ the expression that makes it clear that a person signing a legal document is signing it as a witness. 【用例】 ▷ In witness thereof, the parties sign this document. →その証拠として、当事者は本証書に署名する。 ▷ IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their duly authorized representatives as of the date first mentioned. →以上の証として、両当事者は、冒頭記載の日付に、正当な権限を有する代表者によって、本契約を締結した(契約文例)。 ▷ IN WITNESS WHEREOF the undersigned plenipotentiaries, being duly authorized by their respective Governments, have signed this Convention. →以上の証拠として、下名の全権委員は、各自の政府から正当に委任を受けてこの条約に署名した(ウィーン売買条約末尾)。
