国際ビジネス、渉外法務に役立つ実務表現 instance 【意味】 (裁判の)審級 【参考】 ▷ a specified stage in legal proceedings such as in the phrases in the first, second, etc, instance. ▷ 法律の分野で“in the first instance”といえば、通例、「第一審で」という意味になる。 ▷ わが国では、次のように表記している： 「控訴裁判所」 →court of second instance 「上級裁判所」 →upper instance court 「上告審」(審級を意味する場合) →final appellate instance 【用例】 ▷ a court of first instance →第一審の裁判所 ▷ The parties may determine the court of jurisdiction by agreement, but only in the first instance. →当事者は、第一審に限り、合意により管轄裁判所を定めることができる(民訴法11条1項)。
