国際ビジネス、渉外法務に役立つ実務表現 ratification 【意味】 批准，承認，追認 (v) ratify →～を批准(承認)する，～を追認する 【参考】 ▷ 「追認」とは、一般的には、過去にさかのぼってある事実を認めることですが、法律的には、いったんなされた不完全な法律行為(取り消しうべき法律行為)を後から確定的に有効なものとする一方的な意思表示を意味します< confirmation of a voidable act; confirmation of an act which was not pre-approved and may not have been authorized.>。 【用例】 ▷ ratification of the treaty →条約の批准 ▷ be subject to ratification by ~ →～による承認を条件とする ▷ require formal ratification by ~ →～による正式な承認を要求する ▷ await ratification by Congress →議会の承認を待つ ▷ A revocable act may not be revoked after the person prescribed in Article 120 ratifies it. →取り消すことができる行為は、第120条に規定する者が追認したときは、以後、取り消すことができない(民法122条)。
