国際ビジネス、渉外法務に役立つ実務表現 capacity 【意味】 (法的な)能力，収容能力，収容人数，容量，容積 【参考】 ▷ someone’s ability to do something. In the context of contract law, the term “capacity” denotes a person's ability to satisfy the elements required for someone to enter binding contracts. ▷ 法律の分野では、特に、行為能力を意味する。”legal capacity”も同義。わが国では、「行為能力」を“legal capacity to act”と、「権利能力」を“legal capacity to hold rights”と表記することがある。また、「意思能力」は“mental capacity”と、「当事者能力」は“capacity to be a party”と表記している。 【用例】 ▷ The legal capacity of a person to act shall be governed by his/her national law. →人の行為能力は、その本国法によって定める(法の適用に関する通則法4条1項)。 ▷ have a capacity of ~ →～の収容能力がある ▷ a fuel tank with a maximum capacity of 50 liters →最大容量50ℓの燃料タンク ▷ be filled to capacity →収容人数一杯である
