国際ビジネス、渉外法務に役立つ実務表現 negligence 【意味】 過失，不注意 (adj) negligent →過失の，不注意な (adv) negligently →過失で, 不注意で 【参考】 ▷ the failure to behave with the level of care that a reasonable person would have exercised under the same circumstances. ▷ 不作為も含まれる<Either a person’s actions or omissions of actions can be found negligent.>。 【用例】 ▷ gross negligence →重過失 ▷ slight negligence →軽過失 ▷ contributory negligence →寄与過失 ※不法行為による損害の発生に関して、原告(被害者)にも過失がある場合の、その「寄与した」過失のこと。不法行為による損害賠償訴訟において、被告(加害者)は、しばしば、寄与過失の抗弁を使う。わが国の「過失相殺」に類似する概念である。 ▷ criminal negligence →刑事過失 ※犯罪として処罰されるほどの重い過失のこと。 ▷ by negligence = through negligence →過失によって ▷ negligence in carrying out safety procedures →安全手順を行う際の過失 ▷ death arising from negligence →過失によって生じた死 ▷ negligent driving →不注意な運転 ▷ be negligent in not giving the patient a full examination →その患者に十分な検査をしなかった点で過失がある ▷A person that has intentionally or negligently infringed the rights or legally protected interests of another person is liable to compensate for damage resulting in consequence. →故意又は過失によって他人の権利又は法律上保護される利益を侵害した者は、これによって生じた損害を賠償する責任を負う(民法709条)。
