国際ビジネス、渉外法務に役立つ実務表現 act of God 【意味】 天災，不可抗力，自然災害 【参考】 ▷ 通例、これが発生した場合契約上の義務が免責される。“act of nature”ともいう。なお、わが国では、「天災」は、(文字通り)“natural disaster”と表記している。 ▷ an event caused by natural forces beyond human control, such as a storm, a flood or an earthquake. ▷ Contracts frequently include an act of God clause(also written as a force majeure clause) to allow for non-performance in the event that an act of God makes completing the contract impossible. 【用例】 ▷ The Constructor shall not be held responsible for delays in construction arising from causes beyond its control and without its fault, including, but not limited to, acts of God, civil commotion, strikes, labor disputes, fires, hurricanes, tornadoes, floods, tidal waves, earthquakes, volcanic eruptions and epidemics. →請負業者は、天災、内乱、ストライキ、労働争議、火災、ハリケーン、竜巻、洪水、津波、地震、噴火、伝染病を含む（ただしこれらに限定されない。）、制御不能でかつその責めのない原因により生じる建設の遅延に対して責任を負わないものとする(契約文例)。
