国際ビジネス、渉外法務に役立つ実務表現 construction 【意味】 ① (広く法律上の)解釈, 法解釈 (v) construe →～を解釈する ② 建設, 施工(方法), 建築構造, 建造物 (v) construct →～を建設する 【参考】 ▷ 実務上しばしば”interpretation”と同義で用いられることがありますが、厳密には両者にはニュアンスに違いがあります。すなわち、”interpretation”が「ことばの解釈(字義解釈)」であるのに対して、”construction”は、法の趣旨や当事者の意思なども斟酌して行う「より広い意味での法解釈」というニュアンスの違いがあります。 なお、この意味に対応する動詞は、“construe”<to determine the meaning of the text of a written document (a statute, regulation, court decision, etc.) based on the rules of legal interpretation.>です。 ▷ the process of interpreting a law or a legal document, such as a contract or will. 【用例】 ▷ a liberal[broad] construction →広義の解釈 ▷ a strict[narrow] construction →狭義の解釈 ▷ a strict construction of ~ →～(法律・条文・契約など)を厳格に解釈すること ▷ put a favorable construction on ~ →～を好意的に解釈する ▷ put a false[wrong] construction on ~ →～を間違って解釈する ▷ construe A as B →AをB(だ)と解釈する ▷ ~ can be construed in two different ways →～は二通りに解釈できる ▷ the construction of a new airport →新空港の建設 ▷ under construction →建設中で(の) ▷ ~ is/are currently under construction →～は目下建設中である ▷ a construction industry →建設産業, 建設業 ▷ a construction company[firm] →建設会社 ▷ construction workers →建設労働者 ▷ a modern construction →現代的な建造物
