国際ビジネス、渉外法務に役立つ実務表現 waive 【意味】 ～(権利)を放棄する, ～(に対する要求・主張)を差し控える (n) waiver →権利の放棄, 権利放棄証書 【参考】 ▷ 自主的に，意図的に，任意に法律上の権利を放棄する又は権利の行使を差し控えることで、明示的な放棄だけでなく、黙示的な(例えば、自己が有する権利と矛盾するような行動をとったり、権利を正当に行使できるのに行使しないことによる)放棄も含まれる。 ▷ to voluntarily relinquish or give up a right, claim, or privilege. In legal contexts, a waiver is often documented in writing, but it can also be implied through actions (i.e. doing nothing or acting in a manner inconsistent with the existence or exercise of the right). 【用例】 ▷ waive one’s right to appeal against the verdict →評決に対して上訴する権利を放棄する ▷ sign a waiver →権利放棄証書に署名する ▷ agree to a 30-day waiver of interest payments →30日間の利息の支払いを受ける権利の放棄に合意する ▷ waiver of right to appeal →上訴する権利を放棄すること ▷ If one of the co-owners waives interest or dies without an heir, the waived interest belongs to the other co-owners. →共有者の一人が、その持分を放棄したとき、又は死亡して相続人がないときは、その持分は、他の共有者に帰属する(民法255条)。
