国際ビジネス、渉外法務に役立つ実務表現 bailment 【意味】 寄託(契約) + bailor →寄託者 + bailee →受寄者 【参考】 ▷ a non-ownership transfer of possession; the temporary placement of control over, or possession of personal property by one person(the bailor), into the hands of another(the bailee), for a designated purpose upon which the parties have agreed. 【用例】 ▷ A bailment becomes effective if one of the parties asks the other party to keep a certain thing in custody, and the other party gives consent to keeping it in custody. →寄託は、当事者の一方がある物を保管することを相手方に委託し、相手方がこれを承諾することによって、その効力を生ずる(民法657条)。 ▷ A bailee may not use the bailed thing without obtaining the consent of the bailor. →受寄者は、寄託者の承諾を得なければ、寄託物を使用することができない(民法658条1項)。
