earnest (money)

【意味】
手付金,(契約の)証拠金,内金

【参考】
▷ “earnest payment”も同義で使われる。
▷ A sum of money paid by a buyer at the time of entering a contract to indicate the intention and ability of the buyer to carry out the contract.

【用例】
▷ pay earnest money for the products →製品の手付を支払う
▷ give the seller the earnest money of $100 →売主に100ドルの内金を入れる
▷ return earnest money to the buyer →買主に内金を返す
▷ If the buyer pays earnest money to the seller, the buyer may cancel the contract by waiving the earnest money, or the seller may cancel the contract by actually providing the buyer with twice its amount; provided, however, that this does not apply after the counterparty commences performance of the contract. →買主が売主に手付を交付したときは、買主はその手付を放棄し、売主はその倍額を現実に提供して、契約の解除をすることができる。ただし、その相手方が契約の履行に着手した後は、この限りでない(民法5571)
