国際ビジネス、渉外法務に役立つ実務表現 freedom of contract 【意味】 契約の自由 【参考】 ▷ Freedom of contract is the ability of parties to create the terms of their agreement as they desire, or the process in which individuals form contracts without government restrictions. Through the freedom of contract, individuals possess a general freedom to choose with whom to contract, whether to contract or not, and on which terms to contract. ▷ 以下、わが国の民法521条参照。 【用例】 ▷ the freedom of contract between the worker and the employer →労働者と使用者の契約の自由 ▷ Freedom of Conclusion and Terms of Contract →契約の締結及び内容の自由(民法521条) ▷ Unless otherwise provided for in laws and regulations, any person may freely decide whether or not to conclude a contract. →何人も、法令に特別の定めがある場合を除き、契約をするかどうかを自由に決定することができる(民法521条1項)。 ▷ Parties to a contract may freely decide the contract terms, subject to the restrictions prescribed by laws and regulations. →契約の当事者は、法令の制限内において、契約の内容を自由に決定することができる(民法521条2項)。
