国際ビジネス、渉外法務に役立つ実務表現 recital 【意味】 (契約書冒頭の)説明部分，リサイタル(独奏会,独唱会) 【参考】 ▷ 契約書の冒頭部分で、当事者が当該契約を締結するに至った経緯や理由を記述した部分を意味する。典型的には“whereas...”ではじまる部分をさす。 ▷ the formal statement or setting forth of some matter of fact, in any deed or writing, in order to explain the reasons upon which the transaction is founded. (例) WHEREAS, ABC Company is desirous of purchasing the Products from XYZ Corporation; WHWEAS, XYZ Corporation is willing to sell the Products to ABC Company; NOW, THEREFORE, in consideration of covenants and agreements herein contained, the Parties hereto hereby agree as follows: 「ABCカンパニーはXYZコーポレーションから本製品を購入することを希望し、 XYZコーポレーションはABCカンパニーに本製品を販売することを望んでいる。 そこで、本書に含まれる約束又は合意を約因として、本当事者は本書により以下の通り合意する。」 【用例】 ▷ a piano recital →ピアノリサイタル ▷ a recital of Bach's sonatas →バッハのソナタのリサイタル ▷ give a violin recital →ヴァイオリンリサイタルを行う
