国際ビジネス、渉外法務に役立つ実務表現 bind 【意味】 ～を(法的に)拘束する・義務付ける + (legally) binding →(法的)拘束力のある + be (legally) bound to do →～するように(法的に)義務付けられる, ～する(法的)義務がある 【参考】 ▷ to force someone to do something by law, duty, etc. 【用例】 ▷ This contract (legally) binds X to do →この契約はXが～することを(法的に)義務付ける ▷ a binding agreement →拘束力のある合意 ▷ This contract is binding on both parties. →この契約は両当事者を拘束する。 ▷ The buyer is, in principle, not bound to pay the price until he has had an opportunity to examine the goods. →買主は、原則として、物品を検査する機会を有する時まで代金を支払う義務を負わない(ウィーン売買条約58条(3))。 ▷ If the seller is bound to refund the price, he must also pay interest on it, from the date on which the price was paid. →売主は、代金を返還する義務を負う場合には、代金が支払われた日からの当該代金の利息も支払わなければならない(ウィーン売買条約84条(1))。
